- The Southern Branch of the Duty Family is believed to have been founded by three brothers, William, Matthew, and Richard Duty ( who married Elizabeth Thomas ). These three brothers, according to tradition in the family of Richard Duty, came out of Maryland, down through Virginia, and settled permanently in North Carolina.
The oldest known records of the founders of the Southern Branch of Dutys are deed records. William first bought land in North Carolina in 1761, Richard in 1763, and Matthew in 1765.
William Duty lived in Bute, Warren, and Chatham Counties; Matthew in Bute, Warren, Granville and Caswell Counties, and Richard in Granville and Person Counties. All three men left wills, naming their children who were living at the time the wills were made. There were a total of twenty-six offspring for the three brothers. The Dutys lived on widely seperated farms in North carolina; consequently, there was little communication between them, and much family history was lost. It seems that Williams last place of residence was in Chatham County, North Carolina.
Matthew Duty moved into what wasthen Caswell County, North Carolina, and on September 19, 1781, he bought fromThomas and Elizabeth barnett, for Ninety Pounds, Virginia Money, two hundred acres of land in that county, " on the waters of Whetstone Branch". Matthew spent the remainder of his life - about one year - on this farm. His will, dated June4, 1782, and probated at the September term of court, 1782, gave his wife (notnamed) one third of his real estate for her natural life. After making specific request to his three older sons, William, Soloman, and Richard, he bequeathedthe remainder of his estate, both real and personal, to his wife for " ... Raising, supporting and learning my young children until my son Thomas Duty cametothe age of twenty one years ... '' At that time, the rest of the property ----- land, slaves, stock and household furnishings ----- were to be sold, and the proceeds divided among his heirs. He mentioned " My Beloved Grandson WilliamOwen". Matthews children as named in his will were: William Duty, Sarah Duty, Solomon Duty, Richard Duty, Mary Duty, John Duty, Littleton Duty, Nancy Ann Duty and Thomas Duty.

Of William Dutys six children, only Nancy is definitely known to have remained in Chatham County, and to have died there. Thomas and Russell emigrated about 1797 - or perhaps before - to Russell County, Virginia. Both married there, and lived in that County for about fifteen years, then moved away. Russell had no children; Thomas' family remained in Russell County, Virginia. Thomas is said to have left afamily in Chatham County, North Carolina, mothered, probably, by Martha Brantley, daughter of Joseph Brantley.
