At a Surrogate Court held in and for the County of Ulster at the Surrogates Office in the Village of Kingston on the 22nd day of November 1871.
Present Charles A. Fowler Surrogate

The last will and testament of Rufus Rhodes was admitted to probate and proved as a will of real and personal estate, which with the proofs taken in relation thereto is as follows:

In the name of God Amen I Rufus Rhodes of the town of Marlborough in the County of Ulster and State of New York being of sound mind and memory and considering the uncertainty of this frail and transitory life, do therefor
make, ordain, publish and declare this to be my last will and testament. That is to say. First, after all my lawful debts are paid and discharged, I give and bequeath Elizabeth Rhodes my sister all my property of what kindsoever be
the same real or personal estate. Likewise, I make constitute and appoint Charles Woolsey of the town County and State aforesaid to be Executor of this my last Will and Testament hereby revoking all former wills by me made.
In witness whereof I have hereunto subscribed my name and affixed my seal the eleventh day of July in the year of our Lord one thousand eight hundred and seventy one.

The above written instrument was subscribed by the said Rufus Rhodes in our presence and acknowledged to each of us; and he at the same time declared the above instrument so subscribed to be his last Will and Testament and we, at his request, have signed our names as witnesses hereto, and written opposite our names our respective places of evidence.

In the matter of proving the last will and testament of Rufus Rhodes deceased Ulster Co. LS: Charles F. Woolsey & David d: Cotant being first duly sworn in open Court, on their oaths depose and say that they are subscribing witnesses to the last will and testament of Rufus Rhodes late of the town of Marlborough in the County of Ulster deceased: and these deponents further say, that the said deceased did in the presence of these deponents subscribe his name at the end of the instrument which is now here shown these deponents, and which purports to be the last will and testament of the said deceased and which bears date the eleventh day of July in the year one thousand eight hundred and seventy one: that the said deceased did, at the time of subscribing his name to the same instrument as aforesaid, did declare the same to be his last will and testament: that these deponents did thereupon subscribe their own names at the end of the said instrument, as attending witnesses to the execution thereof at the request of the said deceased, and in his presence and in the presence of each other: and that the said deceased at the time of subscribing his name to the said instrument as aforesaid, was upwards of twenty one years of age: that he appeared to be of sound mind and memory and was not under restraint to the knowledge & belief of these deponents.
