At a Surrogate Court held in and for the County of Ulster at the Surrogate
Office in the town of Kingston on the 27th day of September 1875 Present
Peter Cantine Surrogate
The last will and testament of Isaac Rhodes was admitted to probate and
proved as a will of real and personal estate which together with the proofs
taken in relation thereto are as follows:
The last will and testament of Isaac Rhodes of the town of Plattekill in the
County of Ulster & State of New York. I Isaac Rhodes of said town of
Plattekill considering the uncertainty of time and being of sound mind and
memory do make declare this my last will and testament in manner and form
following: First, I wish and require my executor to pay all my lawful debts
and funeral expenses, to sell and dispose of all of my real estate his [sic]
partly in the town of Plattekill & Marlborough at such time and manner as he
may consider to the best advantage for all parties concerned and after
paying the said or above debts & expenses and deducting his own expenses in
setting up my estate, I give and bequeath whatever sum may be left of my
estate to my sister - Hester Warren wife of James Warren. I hereby appoint
Jonathan Caverly to be sole executor of this my last will and testament In
witness
whereof I have hereunto set my hand and seal this eight day of May in the
year of our Lord one thousand eight hundred and seventy five.

The above instrument consisting of one sheet was now hereby subscribed by
Isaac Rhodes the testator in the presence of each of us, and was at the same
time declared by him to be his last will and testament and we at his request
sign our names hereto as attesting witnesses. Wm Carpenter town of
Marlborough Ulster Co.

In the matter of proving the last will and testament of Isaac Rhodes
deceased Ulster Co. LS:
William Carpenter & Lewis G Rhoads of the town of Marlborough Ulster Co.
being first duly affirmed in open Court, on their oaths depose and say that
they are subscribing witnesses to the last will and testament of Isaac
Rhoades late of the town of Plattekill in the County of Ulster deceased: and
these deponents further say, that the said deceased did in the presence of
these deponents subscribe his name at the end of the instrument which is now
here shown these deponents, and which purports to be the last will and
testament of the said deceased, and which bears date the 8-day of May in the
year one thousand eight hundred and Seventy-five: that the said deceased
did, at the time of subscribing his name to the same instrument as
aforesaid, declare the same to be his last will and testament: that these
deponents did thereupon subscribe their own names at the end of the said
instrument, as attesting witnesses to the execution thereof, at the request
of the said deceased, and in his presence and in the presence of each other:
and that the said deceased at the time of subscribing his name to the said
instrument as aforesaid, was upwards of twenty one years of age, that he
appeared to be of sound mind and memory, and was not under restraint to the
knowledge and belief of these deponents.
